04No Guarantee of Outcomes
Admission, scholarship, visa and immigration decisions are made solely by Third-Party Decision-Makers. Universities make final admission decisions, scholarship providers make award decisions, and embassies, consulates and immigration authorities make visa decisions. Accordingly, the Company does not and cannot guarantee:
- Admission to any university, program or intake.
- The award of any scholarship, grant or financial aid.
- The approval of any visa, residence permit or other immigration outcome, or the processing time of any application.
- The availability of visa appointments, which is controlled by authorities or appointment centers.
- The availability or confirmation of accommodation, which depends on providers.
- Any particular academic, employment or post-graduation outcome.
Our recommendations are based on the information You provide and on the information available to Us at the time they are made. Requirements, fees, deadlines and rules set by Third-Party Decision-Makers may change without notice. A refusal or adverse decision by a Third-Party Decision-Maker does not by itself mean that the Company has failed to perform the Service.
05Your Responsibilities
To allow Us to deliver the Service, You agree to:
- Provide information that is accurate, complete and current, including academic records, identity details, financial information and budget, and tell Us promptly of any change.

Any refund shall be determined in accordance with Section 07, taking into account Services already performed, applicable charges and mandatory legal rights. Atlas Scholars may report suspected fraud to the competent authorities where required or permitted by law.
- Respond to Our requests and provide documents within the timeframes We indicate, so that deadlines set by universities and authorities can be met. We are not responsible for missed deadlines or rejected applications caused by late, incomplete or inaccurate information from You.

The Website, its original content, features and functionality, including the Atlas Scholars name and logo, Package names, original website texts, blog articles, guides, checklists, templates and original content created by Atlas Scholars in Student Pathway Reports, remain the intellectual property of Atlas Scholars SARL or their respective rights holders.

Nothing in this section transfers ownership of Your academic records, application documents or other personal materials to Atlas Scholars.
15Links to Other Websites

These limitations shall not apply to fraud, wilful misconduct, gross negligence or any liability that cannot lawfully be limited or excluded.
Atlas Scholars shall not be liable for decisions made independently by universities, scholarship providers, embassies, consulates or immigration authorities, provided that the Company has fulfilled its own contractual and legal obligations.
18"AS IS" and "AS AVAILABLE" Disclaimer
The Website and its content are provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Website, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. Without limitation to the foregoing, the Company provides no warranty or undertaking that the Website will operate without interruption, that the information on it is complete, accurate or current, or that the Website, its servers or emails sent from the Company are free of viruses or other harmful components.
This disclaimer does not reduce Our obligation to perform the advisory Services You have paid for with reasonable care and skill, in accordance with Your Service Agreement.
Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.
19Force Majeure
Atlas Scholars shall not be held liable for delays or failures to perform its contractual obligations to the extent directly caused by events beyond its reasonable control, including changes in law or immigration policy, suspension of visa services, closure of embassies or visa application centres, strikes, epidemics, natural disasters, war, civil unrest or disruptions affecting third-party systems.
Where such an event affects the delivery of a Service, Atlas Scholars will inform the Client as soon as reasonably practicable and take reasonable steps to minimise the disruption. Where appropriate, the Company may propose an alternative arrangement, revised timeline or temporary suspension of the affected Services.
If the disruption continues for a prolonged period or makes performance of the agreed Service impossible, either party may request termination of the affected Service by providing written notice.
In such circumstances, fees for Services already performed may be retained to the extent permitted by applicable law, while amounts paid for Services that cannot be delivered shall be refunded in accordance with Section 07 — Cancellation and Refunds and any mandatory legal rights.
Nothing in this section excludes liability for circumstances within Atlas Scholars’ reasonable control or limits any rights that cannot lawfully be excluded.
20Governing Law
The laws of the Kingdom of Morocco, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service. Your use of the Service may also be subject to other local, national, or international laws, including the laws of the destination country.
21Disputes Resolution
If You have a concern or dispute relating to Our Services, We encourage You to contact Atlas Scholars at info@atlas-scholars.com so that We may attempt to resolve the matter amicably.
Atlas Scholars will acknowledge Your complaint and aim to provide a response or propose a resolution within 15 business days.
Where a dispute cannot be resolved amicably, it may be submitted to the competent courts of Agadir, Morocco, to the extent permitted by applicable law.
Nothing in this section limits or excludes any mandatory consumer protection rights, including the right to bring proceedings before another competent court where such jurisdiction is provided by applicable law.
The informal complaint procedure does not prevent either party from exercising any legal right or remedy available under applicable law.
22For Users Outside Morocco
Atlas Scholars is established in Morocco and provides educational advisory and study abroad support Services to Students and families who may reside in different countries.
If You access Our Website or use Our Services from outside Morocco, You are responsible for complying with laws and regulations applicable to Your own activities, including any requirements relating to the information and documents You submit.
Atlas Scholars remains responsible for complying with legal obligations applicable to the Company in connection with the provision of its Services.
These Terms are governed by Moroccan law as described in Section 20 — Governing Law. However, nothing in these Terms excludes or restricts mandatory consumer protection rights that may apply to You under the laws of another country, where those rights are applicable under the relevant rules of private international law.
The availability and scope of such rights depend on the circumstances of the contractual relationship and applicable law.
23Language
These Terms of Service may be made available in English and French. Where both language versions are published, Atlas Scholars will take reasonable steps to ensure that they accurately reflect the same contractual provisions.
The language version provided to and accepted by the Client at the time of entering into a Service Agreement shall be identified in the relevant contractual documentation.
Where both versions have been provided and expressly designated as applicable to the same agreement, the French version shall prevail in the event of an inconsistency, to the extent permitted by applicable law.
Nothing in this section limits any mandatory legal rights relating to contractual information, transparency or the language of consumer communications.
24Severability and Waiver
Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Waiver
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
25Changes to These Terms of Service
Atlas Scholars may update or revise these Terms of Service from time to time to reflect changes in applicable law, regulatory requirements, Our Services, operational procedures or Website functionality.
The updated Terms will be published on Our Website with a revised effective date. Where changes materially affect the rights or obligations of Clients, Atlas Scholars will take reasonable steps to communicate those changes in advance, including by email or another appropriate communication method where relevant.
Where reasonably practicable, We will aim to provide at least 30 days’ advance notice of material changes. A shorter notice period may apply where changes are required urgently by law, regulatory requirements or circumstances beyond Our reasonable control.
Changes to these Terms shall not automatically modify an existing signed Service Agreement. Any amendment affecting the agreed scope of Services, fees, payment obligations, cancellation rights or other material contractual terms shall require the agreement of the parties where required by applicable law.
The revised Terms will apply to new Service Agreements entered into after their effective date. Continued use of the Website after publication of revised Terms may be subject to those updated Website provisions, but shall not, by itself, constitute acceptance of amendments to an existing Service Agreement.
Nothing in this section limits any mandatory consumer protection rights or authorises Atlas Scholars to impose unilateral contractual changes contrary to applicable law.
